Can yellowfin tuna be harvested off of a kayak without an HMS permit?

Flip, unfortunately an HMS permit must be registered to the boat or vessel that the yellowfin is caught on in order to be harvest it. If a tuna is an incidental catch on a vessel or platform without an HMS permit, it must be released immediately.

That was my understanding also. A local kayak guide recently posted pictures of a harvested yellow fin, which was confusing as it seemed to go against the HMS rules. Thanks for your reply.
